MINOR MODIFICATION

A MODIFICATION OF THE HAMILTON MAJOR PLACE PLANNED UNIT DEVELOPMENT DETAIL PLAN

 

WHEREAS, the Common Council of the City of Shelbyville adopted Ordinance No. 19-2871 to establish the Planned Unit Development Detail Plan for Hamilton Major Place; and,

 

WHEREAS, pursuant to IC 36-7-4-1511(i) and UDO 9.06-H, the Zoning Administrator may approve minor modifications to the PUD Detailed Plan without the need for a public hearing; and,

 

WHEREAS, a request was filed with the Zoning Administrator on February 8th, 2022 to modify the Hamilton Major Place PUD; and

 

WHEREAS, the Zoning Administrator finds that the requested modifications are consistent with the purpose and intent of the overall development, and that the modifications will not result in a change in type of use or alteration of the development requirements; and,

 

WHEREAS, the Zoning Administrator finds that the requested modifications are needed for the orderly development and implementation of the Hamilton Major Place PUD;

 

NOW, THEREFORE, the Hamilton Major Place Detail Plan is modified as follows:

 

  1. Section 5-C-1 shall be amended to read as follows:
    When the Architectural Control Committee deems it necessary, all plans for Primary Structures, Accessory Structures, additions, and alterations to Primary Structures and Accessory Structures shall be prepared and certified by an architect licensed by the State of Indiana.”
  2. Section 6-A-2 shall be amended to read as follows:
    When the Architectural Control Committee deems it necessary, all Primary and Accessory Structures shall be designed and certified by an architect licensed by the State of Indiana.”
  3. Section 6-B-2 shall be amended to read as follows:
    When the Architectural Control Committee deems it necessary, All Townhome Structures shall be designed and certified by an architect licensed by the State of Indiana.
